Shop Act, EPF & ESIC Registration Noida

Quick answer: In Noida, Shop & Establishment registration applies only at 20 or more employees under the Uttar Pradesh 2025 amendment; ESIC applies at 10+ and EPF at 20+ nationally. Delhi still registers at any size. We check the thresholds first, then file only what is actually due — on UP Labour Department via Nivesh Mitra 3.0.

Uttar Pradesh rule, current as of 4 October 2026: Under the UP Amendment Act 2025 (effective November 2025), registration is mandatory only for establishments with 20 or more employees, within six months of starting. Below 20, no Shop Act registration is required. The amendment also widened 'commercial establishment' to cover medical practitioners, architects and delivery services — so clinics and app-based delivery hubs in Noida are now squarely inside the Act once they cross 20. Delhi is different — its matching amendment is published but not yet in force, so a Delhi office still registers at any headcount. If you have premises on both sides of the border, the two files are not the same file.

We serve Sector 62–63 IT offices and BPOs, Sector 18 retail and restaurants, Expressway-sector startups, Greater Noida's Knowledge Park institutes and the Ecotech manufacturers that also need a factory licence. No Professional Tax is levied in Uttar Pradesh, so if a vendor is quoting you for PT registration here, that is a red flag about the rest of their advice.

What we do

Illustrative client engagement — details anonymised.
Client: A Sector 63 BPO growing from 14 to 35 seats in one quarter.
Situation: Had been told it needed a Shop Act licence from day one and had been quoted for it; it also crossed the EPF threshold mid-quarter without registering.
Approach: Confirmed the 20-employee rule meant no registration had been due earlier, filed the UP Shop Act registration on crossing 20, and registered EPF and ESIC from the correct dates so no retrospective dues or damages accrued.
Outcome: Registered correctly with no back-dated liability; monthly ECR and ESIC filings set up on the 15th cycle.

Frequently asked questions

Does my Noida office need a Shop & Establishment registration?

Under the UP Amendment Act 2025 (effective November 2025), registration is mandatory only for establishments with 20 or more employees, within six months of starting. Below 20, no Shop Act registration is required. The amendment also widened 'commercial establishment' to cover medical practitioners, architects and delivery services — so clinics and app-based delivery hubs in Noida are now squarely inside the Act once they cross 20.

Which portal handles it in Noida?

UP Labour Department via Nivesh Mitra 3.0. We file it, track the acknowledgement and keep the registers the department can ask for on inspection.

When does EPF apply?

At 20 or more employees, nationally — mandatory for employees earning up to ₹15,000 per month, voluntary coverage above. Monthly ECR is due by the 15th. Under the Code on Wages, basic plus DA must be at least 50% of total pay, which raises the PF base for many employers.

When does ESIC apply?

At 10 or more employees (counted at employer level, not per branch), for employees earning up to ₹21,000 per month gross — ₹25,000 for persons with disability. The ₹30,000 ceiling you may have read about has not been notified.

Do I still need a Shop Act certificate for a bank account or GST?

Banks and GST accept other proofs (incorporation certificate, Udyam, rent agreement). If your establishment is below the state's registration threshold, a Shop Act certificate is not something you can or need to obtain — we provide the right alternative proof instead.

What changed with the four Labour Codes?

They came into force on 21 November 2025. For a Shop Act-type establishment the practical changes are the new wage definition, mandatory appointment letters, single registration under the OSH Code at 10+ workers, and the factory-licence threshold moving to 20+ workers with power. State rules are still being finalised; we check your state's current status before filing.
