Assignment (TM-P)
- A registered mark or a pending application can be assigned with or without goodwill, in whole or for part of the goods and services; the new owner applies in Form TM-P with the assignment deed, and the Registry enters the assignee's name, the date and the basis of assignment on the register
- Certification marks need the Registrar's consent; assignment to different people for different parts of India is restricted — draft the deed accordingly
- The deed is stamped per the state's schedule (stamping and registration); update ownership before renewal or enforcement so notices and certificates issue in the right name
Rectification, removal and opposition (TM-O)
- Opposition to a pending application: within three months of its advertisement in the Trade Marks Journal, extendable by one month on request
- Rectification or removal of a registered mark: for non-use — no bona fide use for a continuous period of five years and three months — or because the registration should not have been made (earlier rights, descriptiveness, bad faith)
